If you want to file under a different chapter than your original discharge, you can do so with some limitations. If your first bankruptcy was a Chapter 13, then you have to wait six years to file a Chapter 7. If your first bankruptcy was a Chapter 7, then you have to wait four years from when that case was filed to file a Chapter 13 bankruptcy.
